Italian court rules Netflix must refund customers for years of price hikes

Netflix has been in the spotlight recently due to a significant ruling by a Rome court. The court stated that the price increases imposed by Netflix on subscribers in Italy in 2017, 2019, 2021, and 2024 were deemed unlawful. This decision came as a result of a lawsuit filed by the Italian consumer advocacy group Movimento Consumatori, which argued that these price hikes violated the Consumer Code, a set of laws designed to protect consumer rights in Italy.

According to the court ruling, Netflix is required to refund affected customers up to 500 euros, depending on their subscription plan. The court found that Netflix’s contracts failed to adequately explain why prices or terms might change in the future, making the price hikes invalid.

Movimento Consumatori, through its assisting attorneys Paolo Fiorio and Corrado Pinna, stated that the premium plan saw increases amounting to 8 euros per month since 2017, while the standard plan increases totaled 4 euros per month over the same period. Basic plan subscribers also experienced a 2-euro increase in October 2024.

Netflix has been given 90 days to inform current and former customers of their right to refunds via various communication channels, or face penalties. The ruling also demands that Netflix reduce its current subscription prices to reflect the unlawful increases. Failure to comply with these demands may result in a class-action lawsuit from Movimento Consumatori.

Netflix has announced its intention to appeal the ruling, stating that it believes its terms have always been in accordance with Italian law. This ruling is a significant win for streaming subscribers who feel that prices have been rising unchecked, especially as streaming services were initially promoted as more affordable alternatives to traditional cable TV.

While this ruling specifically affects Italian customers, it sheds light on the growing concerns globally about rising subscription prices for streaming services. Movimento Consumatori’s actions may pave the way for further legal challenges against Netflix and other streaming providers, particularly in the European Union, regarding past pricing practices.
