Poland’s Investigation of Apple’s App Tracking Transparency Policy
Apple is currently under the microscope in Europe, with Poland’s anti-monopoly watchdog launching an investigation into the tech giant’s privacy practices. The focus of the investigation is Apple’s App Tracking Transparency (ATT) framework, which is being examined for potentially impacting competition in the mobile advertising market. This investigation showcases the ongoing debate between safeguarding consumer privacy and ensuring fair market competition, a topic that has gained significant attention in Europe.
At the heart of the matter is the ATT feature, introduced with iOS 14.5, which requires user permission before tracking activity across various apps and websites. While privacy advocates have applauded this feature, concerns have been raised by UOKiK that it could create an unequal playing field. The regulator is worried that while third-party apps face challenges in data collection for personalized ads, Apple’s advertising services may not face the same obstacles.
President of UOKiK, Tomasz Chrostny, expressed doubts about the transparency of Apple’s policy, suggesting that it could potentially mislead users about privacy protections while giving Apple a competitive edge over independent publishers. If confirmed, Apple could face a hefty fine of up to 10% of its annual turnover in Poland. Similar investigations are reportedly underway in Germany, Italy, and Romania, following a significant fine imposed by French authorities earlier this year.
In response, Apple maintains that the ATT framework was designed to empower users with control over their data, not to hinder competition. The company also hinted at the possibility of withdrawing the feature if faced with intense opposition, to the detriment of European consumers.
